Legalisasi dan Maslahah: Studi Pemanfaatan Ganja untuk Pengobatan Medis

Abstract

As of correct time, Indonesian law No. 35 of 2009 governing narcotics still prohibits the trade and use of marijuana. Cannabis plants fall within the category of Group I drugs, which are not allowed to be used for medical purposes. The cannabis plant is thought to have medicinal value, though, and medical marijuana programs have been legalized in more than 50 nations. This study's methodology is a statutory approach to normative research. Document studies are used to gather secondary data for research. This study's data analysis follows a qualitative methodology, in which the findings are presented in a descriptive manner. According to the study's findings, it is permissible to use marijuana for medical purposes because the cannabis plant has positive effects on health and can be advantageous when used in accordance with legal guidelines. The regulation of legalizing cannabis plants for use in medical treatment in this study demonstrates the growing demand for health services, namely the use of cannabis plants, among Indonesians. So that it can be used for medical purposes, the Narcotics Law needs to be updated and the cannabis plant needs to be moved to narcotics class II.
