Hak Politik dan Hukum Aparatur Sipil Negara Perspektif Mashlahah Mursalah
Abstract
This article discusses how issued legal instruments can restrict the political rights of the State Civil Apparatus. Political rights, which are guaranteed by the 1945 Constitution of the Republic of Indonesia and Law Number 39 of 1999 concerning Human Rights, are essentially the rights of every citizen. This right, however, may be constrained by the law. Due to the normative methodology used in this study, legal documents pertaining to the impartiality of ASN have been reviewed. The study's findings suggest that Law No. 5 of 2014 and related laws govern the limitations on ASN's political rights. The prohibition on voting and voting rights is included. Restrictions on the right to vote, such as the requirement that ASN resign as ASN in order to run in general elections. Even the ASN has the right to vote, it is still required to be impartial in the political process, which means that it cannot exhibit bias. Every time there is a general election, even these restrictions are published as circulars. These limitations have demonstrated how the public interest is advantageous. Given that higher mufshadatan will result if ASN is not politically neutral. Because ASN have an intrinsic responsibility to serve as the nation's defenders of integrity and unity in addition to doing their duties as government employees.
