Tarik Menarik Kewenangan Pengawasan Lembaga Baitul Maal Wat Tamwil (BMT) di Indonesia Pasca UU Nomor 1 Tahun 2013
Abstract
The presence of Act No. 1 of 2013 concerning Microfinance Institutions has created legal problems for Baitul Maal Wat Tamwil (BMT) in the form of a cooperative. Previously, BMTs in the form of cooperatives were under the supervision of the Ministry of Cooperatives and Small and Medium Enterprises, the Financial Services Authority (OJK) had no authority over BMTs. After the existence of the law, OJK's involvement in BMTs became more dominant. Thus, BMT is regulated by two regulations, namely the Cooperative Law and the Micro Finance Institution Law. The Cooperative Law appoints the Ministry of Cooperatives and Small and Medium Enterprises as the supervisor and the Micro Finance Institution Law appoints the OJK as the supervisor. This causes overlapping arrangements, supervision and guidance by different agencies. Using a descriptive analytical method using a normative approach, this study aims to discuss how the implementation of Act No. 1 of 2013 concerning Microfinance Institutions and how the overlapping forms of supervision of BMTs with cooperative legal entities is carried out. The results of this study conclude that until now the management of BMT still uses various regulations. Regulatory dualism will make it difficult for Islamic Microfinance Institutions to determine the legal rules that must be complied with. There are several contradictory differences between the two regulations, including the terms of establishment; capital; business permit; scope of business activities; the obligation to make reports; announcement of financial statements; supervision; and threats of sanctions.
