Peran Pengadilan Agama dalam Perlindungan Hak-Hak Perempuan dalam Perkara Perceraian

Abstract


Meskipun perceraian diperbolehkan dalam Islam, kenyataannya perempuan sering kali berada dalam posisi yang rentan secara sosial, ekonomi, dan hukum. Melalui pendekatan yuridis-normatif dan kualitatif, penelitian ini mengeksplorasi peran hakim Pengadilan Agama dalam menafsirkan dan mengimplementasikan peraturan perundang-undangan dan prinsip-prinsip keadilan berbasis gender. Dalam banyak kasus, hak-hak perempuan seperti nafkah iddah, mut'ah, nafkah anak, dan hak asuh anak sering kali diabaikan atau bahkan tidak dipedulikan oleh suami. Oleh karena itu, peran aktif hakim sangat dibutuhkan untuk menggali nilai-nilai keadilan substantif yang berakar pada maqaṣid al-shari'ah, agar perempuan tidak menjadi pihak yang dirugikan pasca perceraian. Selain itu, Pengadilan Agama juga memiliki tanggung jawab edukatif dan mediatif dalam menyelesaikan sengketa rumah tangga, sehingga dapat meminimalisir dampak psikologis dan sosial bagi perempuan. Temuan dalam artikel ini menunjukkan bahwa efektivitas roteksi hak-hak perempuan di pengadilan agama sangat bergantung pada sensitivitas gender para penegak hukum dan keberadaan regulasi yang mendukung perlindungan hak-hak perempuan secara komprehensif dan berkeadilan.
